Terms of Service

These terms describe the agreement between you and The Messaging Lab. They are written to be readable... not to bury anything. If something here is unclear, ask us.

Agreement to Terms

These Terms of Service govern your access to and use of The Messaging Lab at MessagingLab.ai. By creating an account, starting a free trial, or otherwise using the service, you agree to these terms. If you do not agree, do not use the service.

Related policies

Our Privacy Policy and AI Policy are part of this agreement and are incorporated here by reference. Please read all three.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use The Messaging Lab. By using the service, you confirm that both of these are true. If you are using the service on behalf of a business or other entity, you confirm that you have authority to bind that entity to these terms.

The Service

The Messaging Lab is an AI-powered copywriting platform built on the CONNECT Method... a three-story framework for Connect-First Copywriting. The service includes access to the CONNECT AI, the Messaging Guide Builder, the Brand Guide Builder, copy library, HTML deliverables, analytics, and the features described on our Pricing page.

Service availability

We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance, updates, third-party outages, or unforeseen technical issues may result in temporary unavailability. We will use reasonable efforts to restore service promptly.

Service changes

We may add, remove, or modify features over time. Material changes that reduce functionality will be communicated in advance when feasible.

Your Account

You must create an account to use The Messaging Lab. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. Notify us immediately at hello@messaginglab.ai if you suspect unauthorized access.

One account per user

Accounts are for individual use by one person and one business. Sharing credentials with others or creating multiple accounts to circumvent plan limits is not permitted.

Subscription, Billing & Free Trial

Subscription plans

Plans and pricing are described on our Pricing page. Prices may change with at least 30 days notice to existing subscribers. Continued use after a price change takes effect constitutes acceptance of the new price.

Billing

Subscriptions are billed in advance. Monthly plans are billed monthly. Annual plans are billed annually. All payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis until you cancel.

Free trial

New users may access The Messaging Lab free for 7 days. A valid credit card is required at signup. At the end of the trial, your subscription will begin automatically and your card will be charged the applicable subscription fee unless you cancel before the trial ends. You may cancel at any time during the trial from your account settings with no charge.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access until that period ends.

Refunds

We do not offer refunds for partial billing periods. If a technical issue prevents you from using the platform, contact us at hello@messaginglab.ai and we will work to resolve it or issue an appropriate credit.

Your Content

Ownership

You own all content you submit to The Messaging Lab... including your Messaging Guide, Brand Guide, prompts, and the copy generated by the CONNECT AI based on your inputs. We claim no ownership over content you create using the platform.

Limited license to us

You grant us a limited, non-exclusive license to store, process, and display your content for the sole purpose of providing the service to you. This license ends when you delete the content or close your account, except for backups retained for the period described in our Privacy Policy.

No training on your content

Your prompts, your guides, and the copy you generate are not used to train our AI models or any third-party AI models. Your content is yours.

AI-Generated Copy

Your responsibility to review

AI-generated copy may contain inaccuracies, outdated information, or output that does not fully reflect your intent. You are responsible for reviewing all output before publishing or distributing it... particularly factual claims, statistics, testimonials, regulated-industry language, and any specific details about your offer.

Disclosure when publishing

In many jurisdictions, including under FTC guidance in the United States, you may be required to disclose the use of AI in content you publish, particularly if the content includes testimonials, endorsements, or claims that could mislead consumers. Compliance with disclosure requirements is your responsibility.

No guarantee of results

The results described on our website... including email open rates, revenue figures, and client outcomes... reflect real client results from Connect-First Copywriting. They are not guarantees of your results. Performance depends on your offer, your audience, your delivery, market conditions, and how you apply what the platform produces.

Acceptable Use & Prohibited Activities

General

You agree to use The Messaging Lab in compliance with all applicable laws and these terms. You will not use the service to create content that is illegal, harassing, discriminatory, defamatory, or that violates the rights of others.

Prohibited content

You may not use the service to generate or distribute content that: (a) infringes intellectual property rights; (b) constitutes spam, phishing, or fraudulent solicitation; (c) impersonates another person or entity; (d) contains malware or malicious code; (e) sexualizes or targets minors; or (f) promotes violence, self-harm, or unlawful activity.

Prohibited uses

You may not use the service to: (a) provide tailored legal, medical, or financial advice without review and disclosure by a qualified professional; (b) make high-stakes automated decisions about a person's credit, employment, housing, insurance, education, or access to essential services; (c) generate political campaign materials targeted to specific demographics; (d) discourage or interfere with voting or democratic participation; (e) generate disinformation, fabricated endorsements, or content designed to deceive; (f) facilitate real-money gambling or payday lending; or (g) build a competing AI product or train a competing model.

Prohibited technical activities

You may not: (a) scrape, copy, or resell any part of the service; (b) use automated systems to access the service in ways that exceed normal human use; (c) reverse engineer the platform or attempt to access non-public APIs; (d) interfere with security features; or (e) share, sublicense, or resell access to your account.

Consequences

We may suspend or terminate your account for any violation of this section, with or without notice, depending on severity.

Our Intellectual Property

The Messaging Lab platform, the CONNECT Method, Connect-First Copywriting framework, the CONNECT AI prompt architecture, our methodology, our documentation, our brand assets, and all related materials are the intellectual property of The Messaging Lab and Racheal Blackmore. Your subscription grants you a license to use the service. It does not transfer ownership of any of our underlying methodology, technology, or brand.

Trademarks

The Messaging Lab, CONNECT Method, Connect-First Copywriting, and related marks are our trademarks. You may not use them without prior written permission.

Third-Party Services

The Messaging Lab relies on third-party services to operate. These currently include Stripe (payments), Anthropic (AI processing), Vercel (hosting), Supabase (database and authentication), and Resend (transactional email). Your use of the service is subject to their terms and privacy practices to the extent your data flows through them. We have selected providers that meet our security and privacy standards, and we contractually require them to protect your data.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the service will be uninterrupted, error-free, secure, or that it will meet your specific requirements. We do not warrant the accuracy, completeness, or reliability of AI-generated output. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MESSAGING LAB AND ITS AFFILIATES, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless The Messaging Lab and its affiliates, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of: (a) your violation of these terms; (b) your content or your use of AI-generated output; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) your violation of any applicable law.

Termination

By you

You may terminate your account at any time from your account settings or by contacting hello@messaginglab.ai. Termination takes effect at the end of your current billing period.

By us

We may suspend or terminate your access if you violate these terms, fail to pay, or engage in conduct that we reasonably believe harms other users or our service. We may also discontinue the service in whole or in part with reasonable advance notice.

Effect of termination

On termination, your right to use the service ends immediately. Sections that by their nature should survive (including ownership, disclaimers, liability limits, indemnification, dispute resolution, and governing law) will survive.

Dispute Resolution & Arbitration

Informal resolution first

If you have a dispute, contact us at hello@messaginglab.ai first. Most disputes can be resolved informally within 30 days. Both parties agree to attempt informal resolution before pursuing formal proceedings.

Binding arbitration

Any dispute that cannot be resolved informally will be resolved through binding individual arbitration administered in the State of Michigan, under the rules of the American Arbitration Association. The arbitrator will have authority to grant any remedy available in court, subject to the limitations in these terms.

Class action waiver

YOU AND THE MESSAGING LAB AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate or join claims of multiple parties.

Exceptions

Either party may bring an individual action in small claims court for qualifying disputes. Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.

Opt-out

You may opt out of arbitration by sending written notice to hello@messaginglab.ai within 30 days of first agreeing to these terms. Your notice must include your full legal name, the email associated with your account, and a clear statement that you are opting out of arbitration. Opting out does not affect any other provision of these terms.

Governing Law

These terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. For disputes not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Michigan.

Changes to These Terms

We may update these terms from time to time. Material changes will be communicated to active subscribers by email at least 30 days before they take effect. Continued use of the platform after changes take effect constitutes your acceptance of the updated terms.

General

Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force.

Entire agreement

These terms, together with our Privacy Policy and AI Policy, constitute the entire agreement between you and The Messaging Lab regarding the service and supersede any prior agreements.

Assignment

You may not assign or transfer these terms without our prior written consent. We may assign these terms in connection with a merger, acquisition, or sale of assets without notice.

No waiver

Our failure to enforce any right or provision will not be considered a waiver of that right or provision.

Force majeure

Neither party will be liable for any failure or delay in performance caused by events beyond reasonable control, including natural disasters, war, terrorism, riots, labor disputes, internet or utility disruptions, government action, or third-party service outages.
